The charge for pollution load/Compensation benefits/Surcharge rate/Pollution-related health care and welfare project

Overview

 Based on the “Act on Compensation for Pollution-related Health Damage” (Act No. 111 of 1973, hereinafter referred to as Pollution-related Health Damage Compensation Law),and giving consideration to the polluter-pays principle, Japanimplements compensation benefits and pollution-related health care and welfare project for certified patients and provide prompt and fair relief.

The charge for pollution load

 Based on the provisions of Article 52 of the Pollution-related Health Damage Compensation Law, The Environmental Restoration and Conservation Agency of Japan, an independent administrative institution, hereinafter referred to as “ERCA”, collects and receives the charge for pollution load, which covers 80% of the costs required to provide benefits to pollution-related health damage victims, from approximately 8,100 establishers of soot and smoke generating facilities nationwide (those who are obliged to pay the charge for pollution load).

Pollution-related health care and welfare project

 Based on the provisions of Article 46, paragraph (2) of the Pollution-related Health Damage Compensation Law, the Ministry of the Environment establishes the calculation standards for the pollution-related health care and welfare project, receives and approves applications for project plans, and grants operational expenses to local governments through the ERCA.

 R5 targeted projects: services related to (1) rehabilitation, (2) health resort therapy, (3)provision of medical equipment, (4) guidance on medical treatment at home, (5) grant for expenses of influenza vaccination.
